Synopsis:

Alternative dispute resolution (ADR) methods, such as mediation and arbitration, are very established and popular mechanisms for parties to resolve disputes outside of court. Recent years have witnessed an increase in the use of ADR options, not just to avoid litigation in court, but to facilitate the formation of agreements between parties, particularly in areas such as standard essential patents (SEP), life sciences and in research and development collaborations.

Dong Qiyao, Representative of the WIPO Arbitration and Mediation Center Singapore Office

Qiyao Dong holds a PhD in Law from Queen Mary University of London. Since joining the WIPO Arbitration and Mediation Center in Geneva in 2018, Qiyao has administrated a number of WIPO mediation and arbitration proceedings, involving parties from various jurisdictions, e.g. Canada, China, Germany, Japan, Korea, Singapore, Switzerland, United Arab Emirates, United Kingdom, United States, etc.  She is also speaker for the WIPO Center’s webinars, and lecturer for WIPO Summer School in 2019, 2020 and 2021.  Qiyao is currently the Representative of the WIPO Arbitration and Mediation Center in Singapore.

David L. Kreider, Independent Arbitrator

David Kreider is a leading arbitrator of technology, IP licensing and financial disputes. A U.S. trained trial lawyer, David went in-house as the Head of Legal at telecom giants China Mobile and Vodafone, for 15 years.  He was among the first to be included on the general and specialist panels of IP arbitrators of both the Singapore International Arbitration Centre and the Hong Kong International Arbitration Centre.  David has presided over significant IP licensing disputes in Asia and the U.S., as chairman, sole arbitrator, and co-arbitrator, and  has been appointed panellist or expert in more than 200 internet domain name disputes.  He speaks Chinese as a second language and is a licensed solicitor and attorney-at-law in England, Hong Kong, New York, New Jersey, California, Florida, and Washington, D.C.

Lam Chung Nian, Head of the Intellectual Property, Technology & Data Group of Wong Partnership

LAM Chung Nian is the Head of the Intellectual Property, Technology & Data Group. He handles both contentious and non-contentious matters in the areas of intellectual property (“IP”), media, information technology (“IT”), data protection and telecommunications law, and has extensive experience working on regulatory, transactional, enforcement and advisory projects in these areas, counting among his clients multinational companies, listed corporations and government regulators. He has advised on and negotiated IP licensing agreements involving patent pools and standards licensing, and has experience in the mediation of FRAND related disputes.

He is a Fellow of the Chartered Institute of Arbitrators (FCIArb) and has been appointed to the Singapore International Arbitration Centre (SIAC) Panel of Arbitrators for Intellectual Property Disputes as well as to arbitrator and mediator panels of the World Intellectual Property Organisation. He has also served as an IP Adjudicator before the Intellectual Property Office of Singapore. He is the President of the Asian Patent Attorney Association (Singapore Chapter), and has also served as a Co-Chair of the International Bar Association (“IBA”) Communications Law Committee.

Tilman Müller-Stoy, Chairperson of the LESI Dispute Resolution Committee, Partner at Bardehle Pagenberg

Tilman Müller-Stoy is widely recognized as one of Germany’s leading patent litigators with global patent litigation and licensing experience. He has handled and coordinated several hundreds of adversarial patent disputes in courts, patent offices and ADR proceedings. He has vast experience in not only defending against, but also creating, evaluating, and enforcing extensive licensing programs, particularly in the area of SEPs, including FRAND issues. His technical focus is on automotive, telecommunications, IT (hardware and software), consumer electronics, medical devices and pharmaceuticals / biosimilars. Tilman is also qualified as a commercial mediator (MuCDR) and a honorary professor at the Technical University of Munich where he teaches patent law since 2008.
